Trademark History
China's modern trademark system began with the Trademark Law of 1982, amended multiple times to strengthen protection, especially after WTO accession in 2001. Registration is overseen by CNIPA. China operates a first-to-file system, meaning registration priority is given to whoever files first, regardless of actual use.

CNIPA conducts a two-stage examination: formal (1–2 months) and substantive (~9 months). Stricter quality checks since 2024 (registrations dropped 29% vs 2023) mean thorough review. Office actions and clarification requests are common and extend timelines.
Publication & Opposition (3 months)
If approved, the mark is published for a 3-month opposition period. Third parties can challenge registration.
Registration Certificate
Successfully registered mark receives a 10-year certificate, renewable indefinitely. First-to-file principle applies — register early.
